2. Scope

These Terms and Conditions govern the use of this website and all orders placed through it. By placing an order you confirm that you have read and accepted these Terms. We may update them at any time; the version in force at the moment your order is placed is the one that applies to that order.

You may order through this website if you are at least 18 years old and have full legal capacity to enter into a contract.

3. Products and prices

All products are described and photographed as accurately as possible. Colours may appear differently depending on your screen, and measurements may vary slightly between individual garments, as each piece is finished by hand.

All prices are shown in Romanian lei (RON) and include VAT where applicable. Delivery costs are not included in the product price and are shown separately before you confirm your order.

Where a launch price is displayed alongside a struck-through price, the struck-through figure is the standard selling price that applies once the launch period ends.

We reserve the right to correct obvious pricing or description errors. If an error affects an order you have already placed, we will contact you before dispatch and you may confirm the corrected order or cancel it in full.

4. Placing an order

Adding a product to the basket does not reserve it. The contract between you and EMETTE is concluded when we send you an email confirming that your order has been accepted and dispatched.

We may decline an order where the product is unavailable, where the details provided are incomplete or incorrect, or where we reasonably suspect fraudulent use. If we decline an order that has already been paid for, we refund the full amount.

5. Payment

Accepted payment methods are shown at checkout. Payment is processed by our payment provider; EMETTE does not store your full card details at any point.

6. Delivery

In-stock items are dispatched promptly. Estimated delivery is 1–3 business days after dispatch within Romania and 3–7 business days within the European Union, depending on destination.

Delivery times are estimates and may vary depending on the courier and circumstances outside our control. They do not include order processing time. Full details are set out on our Shipping & Returns page.

Risk of loss or damage passes to you when you, or a person designated by you, takes physical possession of the goods.

7. Right of withdrawal and returns

If you are a consumer, you have the right to withdraw from the contract within 14 calendar days of receiving the goods, without giving a reason, in accordance with Romanian Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals.

To exercise this right, notify us at info@emettedesign.com or through the Return & Exchange Request form on this website, before the 14-day period expires.

Returned items must be unworn, unwashed, undamaged and carry all original tags. Returns are made through SAMEDAY easybox. The cost of returning the goods is borne by the customer and is deducted from the refund amount.

We refund the amount received within 14 days of being informed of your decision to withdraw, and we may withhold the refund until we have received the goods back or you have supplied evidence of having sent them.

You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

8. Warranty and conformity

Products benefit from the legal guarantee of conformity provided by Romanian Law no. 449/2003 and Government Ordinance no. 140/2021. If a product does not conform to the contract, you may request its repair or replacement, or a price reduction or contract termination under the conditions provided by law.

This guarantee does not cover wear resulting from normal use, damage caused by incorrect care, or alterations made after delivery.

9. Intellectual property

All content on this website – including the EMETTE name, garment designs, photographs, text and layout – is owned by EMETTE DESIGN S.R.L. or used under licence, and may not be reproduced or used commercially without our prior written consent.

10. Liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under Romanian law. Subject to that, our liability in connection with an order is limited to the value of that order.

11. Complaints and dispute resolution

Please contact us first at info@emettedesign.com – most matters are resolved directly and quickly.

If a dispute cannot be settled, you may address the National Authority for Consumer Protection (ANPC), anpc.ro, including through the Alternative Dispute Resolution procedure (SAL): anpc.ro/ce-este-sal.

You may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

12. Applicable law

These Terms are governed by Romanian law. Any dispute falls under the jurisdiction of the competent Romanian courts, without prejudice to a consumer’s right to bring proceedings in the courts of their place of residence.
